PROGRAM OFFICIAL RULES

No purchase necessary. A purchase will not affect the size of the donation made to the charities.

  1. Program Overview: ACCO Brands USA LLC (“Sponsor”) is sponsoring the Five Star® Vote for the Influencer/Charity Team You Want to Receive a School Supply Donation Program (the “Program”) in which two influencers (each an “Influencer”) will team with two charitable organizations (each a “Charity”) (Influencer and Charity together make up a “Team”) to compete for your Votes (as defined in Rule 4, below) on Twitter and Instagram during the Voting Period (as defined in Rule 3, below). The Team that receives the most eligible Votes during Voting Period will receive the First Prize (as defined in Rule 6). The Team that receives the second most eligible Votes during the Voting Period will receive the Second Prize (as defined in Rule 6). Eligibility: Voting is open only to legal residents of the fifty (50) United States or District of Columbia who are 13 years of age or older at the time of voting and who have either a Twitter or Instagram account (each an “Eligible Social Media Platform”) set to “unprotected” and/or “public” settings (“Eligible Voters”). If you are an Eligible Voter but are a minor, you must have your parent or guardian’s permission to participate. Twitter or Instagram accounts are free, but subject to each platform’s terms of service. If you participate in this Program using your wireless phone, message and data rates may apply. Please consult your wireless-service provider regarding its pricing plans. Program is void elsewhere and where prohibited or restricted by law.

    Employees of Sponsor and all of its advertising/promotion/internet agencies associated with this Program, the Influencers and the Charities (collectively, “Sponsor and Related Parties”) are not eligible to Vote. All federal, state and local laws and regulations apply.

  2. Voting Period. Voting begins at 12:00:00 p.m. Eastern Time (“ET”) on August 1, 2019, and ends at 11:59:59 p.m. ET on September 20, 2019 (the “Voting Period”).

  3. To Vote: To vote for one of the Teams, Eligible Voters must make a post on their own Eligible Social Media Platform account (a “Post”) during the Voting Period and include the hashtag associated with the Team (each a “Team Hashtag”) for which they want to vote (each a “Vote”). The Team Hashtags are as follows:

    a. For Team Shaquem/Kids in Need, use the Team Hashtag #JoinTeamShaquem

    b. For Team Jazz//Boys & Girls Clubs of America, use the Team Hashtag #JoinTeamJazz

    In order to count as a Vote in this Program, your Post can contain the Team Hashtag for the Team you are voting for and no other content, or it can contain the Team Hashtag for the Team you are voting for and other content such as the reason why you are voting for that Team or your own Strength Not Stress story. We would love to hear from you about anything you want to share relevant to the Program, as long as it meets the requirements of Rule 5, below.

    Limit one Vote per Eligible Social Media Platform account and per person on each Eligible Social Media Platform per “week” (defined as 12:00 p.m. ET on Thursday, August 1, 2019 through 11:59 p.m. ET, Sunday, August 4, 2019 for the first week of the Program; 12:00 a.m. ET on Monday, September 16th, 2019 through 11:59 p.m. ET on Friday, September 20, 2019 for the last week of the Program; and for all weeks in between the first and last weeks of the Program from 12:00 a.m. ET on the Monday of said week through 11:59 p.m. ET of the Sunday of said week). Anyone found to set up multiple Twitter or Instagram accounts for purposes of Voting or to Vote from more than one Twitter or Instagram account will be disqualified (or said accounts will be disqualified) from voting. If more than one Vote is submitted per Eligible Social Media Platform account in any given week, all but one of those Votes will be disqualified. Sponsor is not responsible for any technical or other errors arising out of the Social Media Platforms, internet, telecommunications lines or any other sources. Votes not in conformance with these Official Rules will be disqualified.

  4. Requirements to Count as a Vote in the Program: In order for your Vote to count as a Vote in the Program, in addition to meeting all other requirements of these Official Rules, the Post/Vote…

    a. Must be written in English and Entrant’s own original and individual creation.

    b. Must not contain more than one Team Hashtag.

    c. Must conform to message length limitations on applicable platform.

    d. Must not contain any third party copyrighted or proprietary material or otherwise infringe on the intellectual property or other rights of a third party.

    e. Must not include the identification of any individuals, living or dead, other than the Eligible Voter (however, generic references to others, not by name, is acceptable; e.g., “my husband …”, “my boss …”, “my kids …”, etc.).

    f. Must not have been previously entered, and may not in the future be entered, into this or any other contests or competitions, or have won any other awards.

    g. Must not depict Sponsor negatively and be in keeping with Sponsor’s desired image.

    h. Must not mention any products that are competitive to or incompatible with Sponsor’s products, and must not contain any commercial, political, religious, or other third party advertising or messaging. May mention Sponsor’s products, provided it does so in a positive manner.

    i. Must be suitable for general audiences and must not contain any of the following content: (i) defamatory words or statements, including words or symbols that are considered offensive to individuals of a certain race, ethnicity, gender, religion, sexual orientation or socioeconomic group; (ii) any lewd or sexually explicit suggestive content; (iii) any content that promotes use of alcohol, tobacco, firearms/weapons, or any violent, unsafe or dangerous behavior, activities or situations; (iv) threats to any person, place, business or group; (v) profanity or obscenity; (vi) any thing that would disparage or offend persons or organizations associated with Sponsor; (vii) anything which incites, encourages or depicts dangerous conduct, stunts or tricks, or behavior or acts that are unsafe, wrongful or immoral; or (viii) anything that violates federal, state or local laws and regulation.

    j. Sponsor reserves the right in its sole discretion to not count any Post as a Vote if in its sole opinion that Post does not comply with these requirements or these Official Rules.

  5. Donation Determination

    a. First Prize: ACCO will award school supplies in the amount of $35,000 to the Charity associated with the Team that earns the most eligible Votes during the Voting Period.

    b. Second Prize: ACCO will award school supplies in the amount of $25,000 to the Charity associated with the Team that earns the second most eligible Votes during the Voting Period.

    In the event of a tie in the number of eligible Votes received by the two Teams during the Voting Period, the value of the school supplies to be awarded to the Charities associated with the two Teams will be the prizes for the two rankings combined and split evenly between the two Charities ( i.e., the First Prize and Second Prize will be combined for a prize value of $60,000, and each Charity will receive $30,000. In no event will Sponsor be obligated to award more than a combined $60,000 in school supplies to the Charities.)

  6. Announcement of Rankings. Sponsor will update the rankings for each Team each weekday during the Voting Period, and such rankings will be posted at www.StrengthNotStress.com (the “Program Website”) and may also be posted at various times during the Contest on other related social media sites, at Sponsor’s discretion. Within one week of the end of the Voting Period, Sponsor will officially post the final rankings for each Team and the donation amounts to be awarded to each Team on (@FiveStar) and on Instagram (@meadfivestar) and the leaderboard will be updated to show final team rankings on the Program Website.

  7. Sponsor’s Right to Use Your Post/Vote. By uploading a Post with a Team Hashtag you hereby grant to Sponsor a non-exclusive license to copy, edit, reproduce, display, publish, distribute, revise, perform, license, sublicense, sell, exploit, creative derivative works from and otherwise use your Post for advertising, marketing and promotional purposes on Sponsor’s own social media platforms/accounts, on the Program Website and/or Sponsor’s other websites or in other media as determined by Sponsor without geographic or time limitations. In addition, you further consent to Sponsor’s use (at its sole option) of your name, social media handle and likeness in connection with your Post, if submitted therewith.

    In addition, by submitting a Post in this Program, voters agree to indemnify and hold harmless Sponsor and Related Parties, and each of their employees, officers, directors, shareholders, agents and representatives (collectively the “Released Parties”) from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Released Parties, due to or arising out of Post or Sponsor’s use of the Post as authorized herein, including but not limited to claims for trademark infringement, copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation. Voter further agrees to release Sponsor from any and all claims that any commercial, advertising presentation, Web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes voter’s rights with regard to any elements, characters or ideas contained in any Post.

  8. Miscellaneous Terms. This Program is subject to all applicable federal, state and local laws. By participating, you waive any right to claim ambiguity in the Program or these Official Rules. By uploading a Post with a Team Hashtag, you agree to release and hold harmless Sponsor and Related Parties, as well as the other Released Parties and Twitter and Instagram, from and against any and all claims, damages and liability arising out of participation in this Program. By participating in this Program, you agree to be bound by the Official Rules and the Sponsor’s decisions - which are final. Sponsor reserves the right to award cash in lieu of product, in its sole discretion. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any program materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Program. This Program is in no way sponsored, endorsed or administered by, or otherwise associated with, Instagram or Twitter. While you are uploading your Post to your own social media account, you are submitting your Vote to Sponsor and not to Instagram or Twitter.

  9. Notice. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and Related Parties, and the other Released Parties, and all of their agents are not responsible and shall not be liable for: (a) any telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in connection with the Program or in processing of Entries and votes; (b) failed, incomplete, garbled or delayed computer transmissions; (c) late, lost, illegible, incomplete, damaged or misdirected Entries; and (d) any condition caused by events that may cause the Program to be disrupted or corrupted. By participating in this Program, Entrants, participants, and winners (collectively “participants”) all agree that in no event will Sponsor and Related Parties, or any of the other Released Parties, be responsible or liable for any damages of losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of such participant’s access to and use of the Program Site, the downloading from and/or printing material downloaded from said Program Site, submitting an Entry on the Program Site, or voting on the Program Site. Without limiting the foregoing, everything on the Program Site is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Sponsor reserves the right to cancel or modify the Program if fraud, misconduct or technical failures destroy the integrity of the Program; or if a computer virus, bug or other technical problem corrupts the administration or security of the Program as determined by Sponsor, in its sole discretion. In the event of termination, a notice will be posted online, and in Sponsor’s sole discretion, the winners may be determined based solely votes that are received prior to termination (if a sufficient number have been achieved at the time of termination). Alternatively, if termination occurs prior to the Voting Period, or if in Sponsor’s sole discretion online voting is not the best way to determine the winners, Sponsor reserves the right to determine the winners based solely on Sponsor Judging. Any damage made to the Program Site will be the responsibility of the authorized email account holder of the email address submitted at the time of entry. Proof of submitting Entries will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such Entries made by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. In the event of a dispute as to the identity of the Entrant, the Entrant will be deemed the person named in the entry form associated with the Entry. Only one name may be placed on the Entry.

  10. Legal: Except where prohibited by law, as a further condition of participating in this connected with this Program, Entrant or Entrant’s legal guardian agrees that (a) any and all disputes and causes of action arising out of or connected with this Program or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively, by final and binding arbitrations under the rules of the American Arbitration Association (“AAA”); (b) the Federal Arbitration Act shall govern the interpretations, enforcement and all proceeding at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstance will Entrant or Entrant’s legal guardian be permitted to obtain awards for, and Entrant or Entrant’s legal guardian hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorney’s fees, and Entrant or Entrant’s legal guardian further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and/or Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without regard for conflicts of law doctrine, and all proceedings shall take place in Cook County, Illinois.

  11. Privacy: Sponsor’s collection of information in connection with this Program, and use thereof, shall be governed by the terms of Sponsor’s privacy policy posted on the Program Website.
